These Terms of Service ("Terms") are a legal agreement between you and TutSync governing your use of the TutSync mobile app and related web app (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Provider: Aryan Rajput ("TutSync", "we", "us"). These Terms supplement, and do not replace, the Google Play Terms of Service.
1. The Service
TutSync is a learning-management platform that lets academies and coaching centers manage classes, attendance, fees, announcements, and members, with role-based access for admins, teachers, students, and guardians.
2. Eligibility and accounts
- You must be able to form a binding contract to create an account. If you are a minor, you may use the Service only under the supervision of, and with consent from, a parent/guardian or an academy authorized to act for you.
- You sign in with your phone number and a one-time password (OTP). You are responsible for keeping access to your phone and account secure and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on devices you control, for your personal or your academy's internal use. You may not copy, modify, reverse engineer, resell, or create derivative works from the Service except as permitted by law.
4. Your responsibilities and acceptable use
You agree not to:
- use the Service unlawfully or to infringe others' rights;
- upload data about other people (including students) without the authority and consent required by law;
- attempt to gain unauthorized access to the Service, other accounts, or academy data;
- disrupt or overload the Service, or probe/scan its infrastructure;
- misuse the Service to harass, defraud, or harm others.
5. Academy data and content
- Ownership. As between you and TutSync, an academy and its members own the data they enter. You retain your rights in content you submit.
- Your role. Academy administrators act as the controller of the personal data they enter about their members and are responsible for having a lawful basis and any required consents.
- License to operate. You grant us the limited rights needed to host, process, and display that data solely to provide and secure the Service.
- Our handling of personal data is described in the Privacy Policy.
6. Fees
The Service may be offered free of charge or under a plan communicated to you. Fee and payment figures recorded inside the Service are records maintained by academies; the Service does not process real payments and is not a payment processor.
7. Service availability and changes
We may add, change, suspend, or discontinue features at any time. We aim for high availability but do not guarantee the Service will be uninterrupted or error-free.
8. Termination
You may stop using the Service and request account deletion at any time on our account deletion request page. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, TutSync will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, arising from or related to your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim, or INR 1,000.
11. Indemnity
You agree to indemnify and hold TutSync harmless from claims arising out of your misuse of the Service or your violation of these Terms or of others' rights, including claims relating to data you entered about third parties.
12. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of Bijnor, Uttar Pradesh will have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have where you live.
13. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide a more prominent notice. Continued use after changes means you accept the updated Terms.
